Cutting edge: From market entry to operational compliance and clarification of innovative legal issues at national or European level
European and national legislators are regulating the digital economy more and more. In their drive towards digitalisation, companies in the tech sector and the “old economy” are facing challenges presented by tighter and more complex regulations at the national and European levels that are not interlinked. Examples include the regulation of personal data processing (GDPR), use of non-personal data (under the planned Data Act and Data Governance Act), data-driven artificial intelligence (planned AI Act), telecommunications networks and offerings (German Telecommunications Act), ePrivacy (under planned new legislation) and the regulation of platforms by the Digital Markets Act.

There is hardly a business model or project related to digitalisation or technology that can do without regulatory expertise. On the contrary, it is frequently the regulatory framework that determines the design of a business model, project or transaction and often its success or failure will hinge on maximising regulatory possibilities while staying within their bounds.

We structure large, regulatory-driven projects and transactions in the tech sector as well as new business models. Based on our experience as a market-leading firm in core regulatory areas over many years, we assist our clients in implementing their projects in a way that they will stand the test of time and we also provide seamless, one-stop advice – from inception to roll-out – on the contractual, commercial and corporate relationships involved.
